This document outlines how our partnership will work. What we promise each other and logistics.

Definitions and notification of charges
By being a member of theconsciousbride.co.uk website [“The Conscious Bride”] and all sub-domains, which are a service of The Conscious Bride you are agreeing to be bound by the following terms and conditions [the Terms of partnership or “The Agreement”].
The Conscious Bride may change these terms at any time by emailing you. Your continued partnership after changes means you agree to be legally bound by these terms as updated and/or amended.
You must be 18 years of age or older or you will not be able to enter into a legally binding contract to sell via The Conscious Bride.
These terms shall be governed by and interpreted in accordance with the law of England and Wales.
You must not use The Conscious Bride for any illegal or unauthorised purpose and you agree to comply with all ‘local’ laws regarding online conduct and acceptable content.
You must not breach any laws, sell any counterfeit items or otherwise infringe the copyright, trade mark or other rights of third parties.
The Conscious Bride reserves the right to choose, with you, from your products the most appropriate items to list and to remove those listings if deemed appropriate.
Changes will be in line with sales/customer demand, seasonal updates and if a change was made to your product or production that means it no longer meets the values of The Conscious Bride.
The Conscious Bride will request to borrow your sample product from time to time, if available, to create themed photoshoots for website use and promotions.
The Conscious Bride reserves the right to only use the imagery we have created however we will release imagery to makers to use across their social media platforms to advertise their products available via theconsciousbride.co.uk.
If you have images from brides, with the and the photographers consent we would love to share them for you.
Within your listing the customer can ‘contact the maker’ this will enable them to complete a contact form which will automatically be emailed to you (and not The Conscious Bride although a copy will be stored by us). By agreeing to these terms you agree to respond to a customer query within 48 hours.
You must inform The Conscious Bride at email@example.com if you cannot meet this obligation due to a holiday or illness and we will update the customers on your behalf with this fact.
Regular failure to correspond with customers leading them to complain to us will result in your listings being removed from the site.
Under no circumstances will The Conscious Bride be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g)any indirect, consequential, special or exemplary damages arising from the use of regardlessThe Conscious Bride of the form of action.
Goods for Sale - Handmade
If you seek to sell products then all goods sold as “handmade” must be deemed not to have been produced through “mass production” methods and must be the original design or produce of the seller.
Content and Copyright
You must not copy, modify, or distributeThe Conscious Bride’s copyrighted works or trade marks, or other content from the Site, without our express consent.
Your products must be your own original work which you have the right to make available and is not defamatory, does not infringe any law and indemnifyThe Conscious Bride against all legal fees, damages and other expenses that may be incurred by The Conscious Bride as a result of your breach of the above warranty.
Sale and returns
You must post items purchased from you after receipt of order confirmation in the time frame specified in the listing unless you cannot for a reason explained to The Conscious Bride.
We will send you confirmation of the purchase with all the relevant customer details.
We complete banking every Friday and will send you funds by direct transfer. We are working on a more instant system within Stripe.
Refunds will be dealt with directly by The Conscious Bride who will contact both the buyer and the seller to confirm. The seller is expected to return funds to The Conscious Bride if a refund is agreed within 28 calendar days.
The sales contract is between each individual "seller" and the "buyer". The Conscious Bride provides a service to facilitate that contract but is not responsible for it or its fulfilment.
All sellers agree to abide by the Consumer Protection (Distance Selling) Regulations 2000 http://www.legislation.gov.uk/uksi/2000/2334/contents/made . This law protects the consumer when buying over the internet or by mail order and applies to all member states of the EU. The Conscious Bride aims to make it easy for sellers to comply with the DSR and consumer law, however, all compliance is the responsibility of the seller.
Sellers must post items purchased within five working days of The Conscious Bride receiving payment unless otherwise clearly stated on the product description OR if the buyer's identity and / or address has not been authenticated.
In using The Conscious Bride, sellers agree that the buyer has a right to terminate the contract and return the item even if the item is not faulty in any way (this is the consumer's right in UK law). They have the right to do this up to 14 days after receipt of the items and a full refund including the cost of standard outgoing postage must be made within 14 days of the seller receiving the returned item(s), or within 14 days of the buyer providing evidence that the item(s) have been returned (e.g. proof of postage), whichever is sooner. Unless the seller has stated otherwise or the item is faulty, the buyer is responsible for paying for the cost of return postage.
If the goods have not yet been sent, refunds must be provided within 14 days of receipt of the notification of cancellation.
Unless faulty, the following types of items are non-refundable: items that are personalised, bespoke or made-to-order to your specific requirements; items which deteriorate quickly (e.g. food), personal items sold with a hygiene seal (cosmetics, underwear) in instances where the seal is broken.
Return of faulty goods
The consumer has a right to return goods if they develop a fault within six months of receipt of the goods, unless the items are made to order or bespoke when the seller will specify a timescale. Depending on the circumstances, they may be entitled to a refund (full or partial), a repair or replacement.
Lost items. If the item is lost in transit then, unless proven otherwise, the seller should assume the contract is terminated and provide a refund or deliver the same item.
Data and Privacy
You must not collect information about users, including email addresses, without their express consent.
You must agree to the terms of the The_Privacy_Policy.
Changes to the Service
The Conscious Bride retains the right to terminate or change the service for any reason at any time without notice.
You agree to pay the fees set out in our The_Fees_Policy.
The Fees Policy
There is currently a standard listing fee of £10 per calendar month with a minimum of 6 months, although we sometimes off promotions or exclusive offers. This will be debited monthly via direct debit.
We charge a commission fee of 12% plus card transaction fee currently 1.4% +20p when you sell an item.
Listings do not have an end date so will run as long as we (The Conscious Bride) wish them to.
The Conscious Bride will transfer the funds from the purchase to you on a Friday after they have been transferred to us from the card processor minus the commission plus vat.
We reserve the right to change this policy at any time however we promise it will not be changed mid contract.
The Conscious Bride complies with the principles of the General Data Protection Regulation when dealing with all data received from visitors to the site.
We only hold the data necessary to offer services provided on our website namely to allow users of the service to buy and sell and also message one another. We also keep user data to allow us to contact you in the advent of account withdrawal or new passwords being provided.
We only hold personal data for as long as necessary. Once data is no longer needed it is deleted from our files.
We regularly email news and information updates to those customers who have specifically subscribed to our email service.
We will never add customers to our email service without express consent. All subscription emails sent by us contain clear information on how to unsubscribe from our email service.
We never sell, rent or exchange mailing lists. We may however share commercial and technical data with our partners where a customer has accessed and used our website. This data would not be personal data but would be anonymised [for example the kind of data you see in "Google Analytics"].
In accordance with the Privacy and Electronic Communications (EC Directive) Regulations 2003 and General Data Protection Regulation, we never send bulk unsolicited emails, (popularly known as Spam) to email addresses. All emails sent by us will be clearly marked as originating from us. All such emails will also include clear instructions on how unsubscribe from our email service and any future emails. Such instructions will either include a link to a page to unsubscribe or a valid email address to which you should reply, with "unsubscribe" as the email subject heading.
